On the 29th day of August 2015, Police observed a motor vehicle being driven southbound on Division St within the Town of Cobourg without its headlights activated. Police further observed the vehicle to be speeding and driving erratically. Subsequently the vehicle was stopped and driver found to be impaired by alcohol.
The driver was arrested and taken to the Cobourg Police Station for breath testing. The driver was found to have more than the legal allowed amount of alcohol in his blood. Subsequently the driver was charged with impaired operation of a motor vehicle and exceed 80mgs of alcohol per 100 ml of blood.
Michael HARVEY of Trenton ON has been charged with impaired operation and operating with over 80mg of alcohol contrary to the Criminal Code with a court date of the 9th day of September 2015. HARVEY has been suspended from driving for 90 days and his vehicle impounded for 7 days under the Administrative Driver’s Licence Suspension (ADLS) legislation.
Under the Ontario Highway Traffic Act, anyone charged with a drinking and driving criminal offence will have his or her driver’s licence suspended for 90 days and their vehicle impounded for seven days, even if they are not the registered owner of the motor vehicle.
